Dispute resolution and binding arbitration

Any dispute or claim arising out of or relating to these Terms or your use of the website that cannot first be resolved informally will be settled by binding arbitration administered under the Federal Arbitration Act and, where applicable, the Georgia Arbitration Code (O.C.G.A. § 9-9-1 et seq.), before a single arbitrator, in Cobb County, Georgia. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and Nolan Plumbing Services LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a class or representative proceeding.

Small-claims and opt-out. Either party may bring an individual claim in a Georgia small-claims court if it qualifies. In addition, you may opt out of this arbitration agreement by sending written notice of your decision to opt out to the contact information below within 30 days of first agreeing to these Terms. This dispute-resolution section does not apply to the collection of amounts you owe for services performed, which we may pursue in court. Nothing in this section limits either party's right to seek injunctive relief to protect intellectual property or confidential information.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the website after changes take effect constitutes acceptance of the updated Terms.
